What is an off-market sale?

An off-market sale is a property sale that is never advertised publicly: it does not appear on Idealista, Rightmove or the agency’s own website, there is no signage, and no photographs are circulated. The property is introduced individually to pre-qualified buyers who have signed a non-disclosure agreement. Wanting to sell and wanting it known are two different things

Most of the owners who come to us privately are not being secretive. They have a specific person, or a specific room full of people, they would rather not have this conversation with yet.

Tenants in place

A listing is how a lot of tenants find out their home is being sold — usually from a friend who saw it online. Selling privately lets you tell them yourself, at the right moment, with the legal side already prepared.

Family and inheritance

Inherited properties and separations come with several owners and a lot of opinions. A public listing turns a private negotiation into a family-wide announcement before anything is agreed.

A visible name locally

In an urbanisation of forty villas, a board on the gate is a piece of news. If you run a business here, sit on the community board or are simply known, that news travels faster than the sale does.

Testing the price first

A private mandate lets you find out what a real buyer will actually pay before your asking price becomes public — and before a price cut becomes public too.

No deadline

Some owners will sell only at the right number, to the right buyer. That is a bad fit for a public listing, which decays visibly with every week it stays up, and a good fit for a private one.

You approve each buyer by name and can veto anyone — a neighbour, a competitor, a family member — with no explanation required.

Viewings on your terms

Times, access and cover story are agreed with you in advance. If tenants are in place, no viewing happens without your written go-ahead.

A clean history

No public listing means no price-drop record and no days-on-market count following the property around if you later decide to go open.

Off-market is not automatically better. If your property is a mainstream two-bedroom apartment with dozens of near-identical comparables, or if you need to complete by a fixed date, an open listing will normally get you a better price faster — competition is exactly what that kind of property needs. We would rather say that at the first meeting than take a private mandate we cannot serve.

  • What is an off-market sale?

    An off-market sale is a sale that never appears on a public portal. The property is not advertised on Idealista, Rightmove or our own website, there is no board on the gate and no photographs circulate. Instead, the property is presented one by one to buyers we already know, after they have signed a non-disclosure agreement. Around the Costa del Sol these are also called discreet, silent or private sales.

  • Who is SolProp Private Market for?

    Owners who have a genuine reason not to be seen selling: landlords with tenants who have not been told yet, families settling an inheritance, people going through a separation, owners with a public or professional profile in the area, and anyone who simply does not want the neighbours or the urbanisation committee discussing their business.

  • Do I get a lower price by selling off-market?

    Not by definition. What you lose is bidding pressure from a wide open market; what you gain is a buyer pool that is pre-qualified and rarely negotiating on the basis of days-on-market. In the upper segment on the Costa del Sol, where a property that has been publicly listed for eight months is discounted by the market itself, staying private often protects the price rather than costing it. We tell you honestly, before you commit, whether we think your specific property is better off public.

  • Who actually gets to see my property?

    Only buyers on our private list who match your property on budget, area and type, and who have signed an NDA covering the address, the photographs and the fact that you are selling. You approve the list of names before anyone is contacted. If there is a buyer you do not want approached — a neighbour, a competitor, a relative — you say so and they are excluded.

  • Can my tenants stay unaware while the property is on the private market?

    Yes. Viewings are arranged only with your written go-ahead, at times you choose, and are presented in a way that does not require announcing a sale. Under Spanish law a tenant with a valid contract keeps their rights when the property changes hands, and depending on the contract may have a right of first refusal (tanteo y retracto), so at some point they will need to be informed. We plan when and how that happens with you and your lawyer, rather than letting them find out from a portal.

  • Do I have to sign an exclusivity agreement?

    For a private mandate, yes — discretion only works if one team controls who knows. The mandate is time-limited, states in writing what may and may not be published, and can be converted into a normal public listing at any moment if you decide you would rather go open.

  • What does it cost?

    The same commission as a standard sale, agreed in advance in the mandate and paid only on completion. There is no registration fee and no charge for the valuation. The other selling costs are the usual Spanish ones: municipal plusvalía, capital gains tax if there is a gain, and a 3% retention on the sale price if you are a non-resident.

  • How long does an off-market sale take?

    It varies more than a public sale. Some properties are matched to an existing buyer in weeks; others wait months for the right person to appear, and that is precisely the trade-off you are choosing. If your timing is fixed and tight, we will say so and recommend a public launch instead.

  • What happens if no private buyer appears?

    You keep every option open. Because nothing was ever published, your property carries no listing history, no price-drop record and no days-on-market count. Going public afterwards means launching fresh, which is not true of a property that has sat visibly online for a year.
